You will generally not qualify for Proposition 36 or PC 1000 programs for drug sales or trafficking crimes. These are reserved for drug possession and drug use crimes. However, where there is no defense, many of these cases can be plea bargained down to a possession case in order to qualify for one of the above programs.

If you plead to a sales charge, this counts as a “prior” and if you get another sales charge, this enhancement can add an additional time of 3 years to a future sentence. Another enhancement on sales and trafficking cases are weight enhancements which carry additional terms of years depending on what the weight is of the drug or what the drug is.
